19670926 1967-5that ORDINANCE NO. 1967-5 AN ORDINANCE regulating the accumulation of trash, litter, rubbish or other waste matter to prevent the same from being carried onto streets, sidewalks, public places or private property. BE IT ORDAINED by the City Council for the City of Fairfax 1. Chapter 10 of the City Code of the City of Fairfax is hereby amended as follows: Section 10-3 Trash, litter, rubbish, etc., on commercial, industrial, or other property. (a) It shall be the joint and several responsibility of the owner and occupant of commercial and industrial land or buildings to provide a sufficient number of containers for storage of refuse to prevent overflow between times of collection, and to maintain the premises in accordance with the standards of this chapter. (b) The owners and occupants of all developed commercial or industrial property within the limits of the City are hereby required to install and maintain trash receptacles on the edge of all sidewalks or other designated pedestrian walkways within said property. These receptacles shall be placed at a maximum of sixty (60) feet apart, unless the Director of Public Works determines that this distance is not practicable. They shall be of a type and size suitable for the purpose and clearly designated as receptacles of trash. (c) It shall be unlawful for the owner or occupant of any private property within the limits of the City to permit the accumula- tion of trash, litter, rubbish or other waste matter upon said property in any manner which may cause or permit the said trash, litter, rubbish or other waste matter, or any part thereof, to be carried or deposited by the elements upon any street, sidewalk or other public place or upon any other private property. (d) The Director of Public Works shall give written notice to the record owner and the known occupant, or occupants, or their agents of such property by certified mail of any violation of this section found by him or his authorized designee to exist and shall require correction of the condition within five days of the receipt of said notice. (3) Any person who shall be in violation of the provisions of this section and who, upon receipt of written notice from the Director of Public Works to correct the same, shall fail or refuse to correct the violation within the time prescribed, shall be guilty of a misdemeanor and upon conviction thereof, be punished as provided by section 1-7.
