AN ORDINANCE TO PROVIDE REGULATIONS FOR THE
COLLECTION OF REFUSE IN THE CITY OF FAIRFAX
The City Council hereby ordains as follows:
The following regulations governing the collection of
refuse in the City of Fairfax and the means of enforcing the same
are hereby established:
I. COLLECTION ZONES AND SCHEDULES:
(1) Under the direction of the city Manager the City
shall be divided into collection zones with the object of afford-
ing one regular refuse collection for each zone each week. Normally
no collections will be made on Saturdays, Sundays and official hol-
idays. Where a collection is not made because of inclement weather,
a holiday or other declared reason, the zone affected will be fur-
nished a collection on the next working day. Collections shall be
limited to single family residential dwellings.
II. ACCEPTED MATERIALS FOR REGULAR COLLECTION:
(1) The following materials will be collected on regular
collection schedules: garbage, kitchen waste, cold ashes and other
refuse which is accumulated as a result of normal household activities.
(2) Poisons, acids, caustics, explosives, hot ashes, and
other dangerous materials will not be collected.
(3) Grass, weeds, brush, newspaper and similar items
may be placed in approved containers or may be placed in neat and
compact bundles or boxes in such a manner to permit handling by
one man. Such bundles or boxes shall be placed at the curb on
the regular collection day by the occupant.
(4) Large single items, such as furniture and appliances,
placed at the curb by the occupant on the regular collection day
will be accepted provided doors are removed from all such items.
(5) Ail unacceptable items will be identified by collect-
ors with a red tag bearing the date of rejection and shall be re-
moved by the occupant within twenty-four (24) hours of such re-
jection date.
III.
(1)
APPROVED CONTAINERS:
The following containers are approved:
Garbage and ashes: Min. 3 gal. Max. 10 gal.
Mixed garbage, trash and other refuse: Min.
10 gal. Max. 31 gal.
(2) All containers shall be made of metal or approved
plastic, equipped with handles and with tight fitting covers and
designed for the storage and collection of refuse. No single
container shall exceed 60 lbs. in weight when full, or five feet
in height or length.
IV. RESPONSIBILITY OF OCCUPANT:
(1) The responsibility for storage of refuse prior to
collection shall remain with the occupant of each building from
which it is to be collected.
(2) On the day of collection refuse shall be placed
outside at the rear or side of the building in a single place that
is easily and safely accessible and not more than 150 feet from
the nearest curb or point of pickup; provided, however, that
occupants of townhouse dwellings shall place all refuse at the
curb in front of said dwelling. Where property is fenced, gates
must be left unlocked.
(3) Once trash containers are emptied by the collecting
crew, the containers shall be removed from the curb to their orig-
inal location by the occupant no later than 8:00 P.M. of the same
day.

V. SPECIAL COLI.ECTION SERVICE:
(1) Refuse which cannot be placed in approved con-
tainers may be collected by special pickup arranged by telephoning
the Department of Public works. All special pickup items shall be
placed at the curb by the occupant but not until pickup arrangements
have been made with the Department of Public Works. The occupant
shall not place such items at the curb more than twenty-four (24)
hours before the designated pick-up date.
(2) The city Manager shall promulgate pickup schedules
for leaves, christmas trees, and other special collections.
VI. ENFORCEMENT:
(1) The City Manager is authorized to discontinue
collection service to any person failing to comply with these
regulations ·
(2) It shall be unlawful for any person to maintain
or accumulate items of refuse at the curb or other pickup point
which are not prepared and contained as required by this ordinance.
(3) Any person who intentionally violates the provisions
of this ordinance shall be guilty of a misdemeanor and upon con-
viction thereof shall be punished by fine not to exceed Twenty-Five
Dollars ($25.00).
