AN ORDINANCE ADDING SECTION 13-75.1 TO THE CODE OF THE CITY OF
FAIRFAX, VIRGINIA, TO ALLOW A FINDING OF IMPROPER DRIVING BY THE
COURT WHERE A PERSON IS CHARGED WITH RECKLESS DRIVING AND THE DEGREE
OF CULPABILITY IS SLIGHT.
BE IT ORDAINED by the City Council of the City of Fairfax, Vir-
ginia, that the Code of the City of Fairfax, Virginia, be amended by
adding a section numbered 13-75.1, as follows:
"Sec. 13-75.1 - Improper Driving.
Notwithstanding the foregoing provisions of this article,
upon the trial of any person charged with a violation thereof
where the degree of culpability is slight, the court in its
discretion may find the accused not guilty of reckless
driving but guilty of improper driving and impose a fine not
to exceed one hundred dollars."
This ordinance shall take effect immediately upon its passage.
