20040413 r-04-15 R-04-15 RESOLUTION NO. RESOLUTION TO APPROVE THE REQUEST OF APPLE FEDERAL CREDIT UNION, BY DAVID REED, ATTORNEY/AGENT, FOR SPECIAL EXCEPTIONS TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES IWaNOWN AS 9701 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 58-3- ((05))-01-002 & 003. WHEREAS, Apple Federal Credit Union, by David Reed, attorney/agent, has submitted Application No. SE-358-03-1 requesting a Special Exception, pursuant to City Code Section 110-763, to reduce the required 25-foot front yard along the Trapp Road frontage; Special Exceptions, pursuant to City Code Section 110-263, to reduce the required 25-foot-side perimeter parking lot landscaping requirements along the Trapp Road frontage, to allow the existing nonconforming perimeter parking lot landscaping requirements along the western side of the subject property to remain, and to allow the existing nonconforming buffer screening from the adjacent residential properties to the south to remain; and Special Exceptions, pursuant to City Code Section 110-158, to reduce the required parking space dimensions along the Trapp Road frontage and to allow an existing nonconforming drive aisle to remain on the southern side of the subject property; WHEREAS, City Council has carefully considered the application, the recommendation of the staff, and the testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by the City of Fairfax Code Sections 110-366, 110-158, 110-263, and 110-763(6) for the following reasons: 1) The proposed use of the subject property as a commercial office building with a drive- through banking facility is permitted in the C-1 Office Commercial District with approval of a Special Use Permit issued by the City Council; 2) The proposed improvements satisfy the Special Use Permit and Special Exception criteria in the City's zoning regulations; 3) The proposed development is not contrary to the objectives specified in the Comprehensive Plan; 4) The proposed addition and drive-through banking facility would not impede the existing traffic flow or impact pedestrian and vehicular safety; 5) The proposed development would not adversely affect nearby residential areas; and 6) The proposed project would not result in a development that is disproportionate to surrounding land uses in size, bulk, or scale. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 13th day of April, 2004, that Application SE-358-03-1 be and hereby is APPROVED, WITH THE FOLLOWING CONDITIONS: 1. The applicant shall consolidate Tax Map Parcels 58-3-((05))-01-002 & 003 during the site plan approval process; 2. The applicant shall remove the existing freestanding automatic teller machine (ATM) prior to the issuance of a Non-Residential Use Permit; 3. The applicant shall remove the existing pylon sign prior to obtaining a building permit; and 4. The applicant shall install a "No Right Turn" sign on the island adjacent to the drive- through banking lanes. 5. The proposed development shall be constructed in substantial conformance with the Special Use Permit/Special Exception Plat and Landscape Plan, prepared by Th-Tek Engineering and dated March 10, 2004, and the architectural elevations, prepared by Wisnewski Blair & Associates, Ltd. and dated April 5, 2004. 6. The applicant shall maintain the perimeter buffer strips in good repair, including: maintaining all plant material, lawn areas and fences, as well as, removing any debris on a consistent basis.
