20040511 r-04-19RESOLUTION R-04-19 RESOLUTION TO APPROVE THE REQUEST OF THE CITY OF FAIR_FAX SCHOOL BOARD FOR A SPECIAL EXCEPTION TO CHAPTER 110 OF THE CITY CODE TO ALLOW THE PROPOSED BUILDING EXPANSION WITHOUT SATISFYING THE REQUIREMENTS FOR PARKING LOT IMPROVEMENTS; AND, TO ALLOW PARKING SPACES WITHOUT THE REQUIRED SEPARATION FROM AN ADJACENT STRUCTURE ON THE PREMISES KNOWN AS 3801 JERMANTOWN ROAD (SIDNEY LANIER MIDDLE SCHOOL), AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-1-((2))-5A. WHEREAS, the City of Fairfax School Board has submitted Application No. SE-378-04-1 requesting a Special Exception to the City Code sections listed below: Section 110-152(h)(3) - General Provisions. No structure or site which is nonconforming with respect to this division shall be altered in any manner which would enable the structure or site to accommodate any increase in business capacity unless and until the requirements of this division are satisfied with respect to such alteration and increase in capacity. However, if the aggregate increase in the gross floor area of the structure should exceed 30 percent of the existing gross floor area, or if the business capacity should otherwise be increased by more than 30 percent, then the entire site shall comply with all applicable provisions of this division. Section 110-153 - Required Improvements. (3) Separation from structures. Where parking spaces are contiguous to a structure, such landscaped strip or sidewalk shall be not less than six feet in width. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110-158 and Section 110-366 for the following reasons: 1. The proposal is not inconsistent with the objectives of the Comprehensive Plan; 2. The proposal will not result in increased traffic congestion or otherwise negatively impact traffic flow or pedestrian and vehicular safety; and 3. The proposal will not adversely impact adjacent property or the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 11th day of May 2004, that Application No. SE-378-04-1 be and hereby is APPROVED, as requested. The motion to adopt the resolution was approved 5-0.
