A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A
PURCHASE AGREEMENT WHEREBY THE CITY WILL AGREE TO
PURCHASE 9817 ASHBY ROAD, FAIRFAX, VIRGINIA 22030, SUBJECT TO
CERTAIN TERMS AND CONDITIONS.
WHEREAS, the City has determined that there is a public need for open space
and a public park on approximately 3.17 acres of property, with an address of 9817
Ashby Road, Fairfax, Virginia, 22030, identified as Tax Map No. 58-1-03-000-A, owned
by Donald D. Conard and Carmen S. Conard; and
WHEREAS, on May 25, 2004 the City Council held a public hearing regarding
the acquistion of the Property and received a positive response from the community and
decided to proceed with the acquisition; and
WHEREAS, the owners have agreed to sell the property to the City for Five
Hundred Seven Thousand Five Hundred and 00/100 Dollars ($507,500.00), with a
closing date on or before August 27, 2004; and
WHEREAS, in order to carry out the purchase of the Property, the City Council
has determined that it is in the best interest of the City to authorize the City Manager to
execute the Purchase Agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax, that
the City Manager is hereby authorized to execute a purchase agreement for the
acquisition of 9817 Ashby Road for a total purchase price of $507,500.00, plus settlement
costs.
BE IT FURTHER RESOLVED that the City Manager is authorized to execute all
other documents necessary to effectuate the acquisition of the property on behalf of the
City.
