20040727 r-04-63RESOLUTION NO. R-04-63 a resolution authorizing the City Manager to execute a THIRD AMENDMENT TO Lease on behalf of the City EXTENDING THE CURRENT LEASE with Main Street Child Development Center, INC., for approximately eight thousand (8,000) square feet of space in the former Green Acres Elementary School FOR AN ADDITIONAL SIX MONTHS. WHEREAS, on May 14, 2002, the City Council authorized the City Manager to execute a Lease with Main Street Child Development Center, Inc., for a portion of the former Green Acres Elementary School for use as a nursery school; and WHEREAS, the initial term of the Lease was for two years, ending on June 30, 2004; and WHEREAS, the City and Main Street Child Development Center executed a First Amendment to Lease on June 13, 2002, extending the term of the Lease for an additional six months, to December 31, 2004; and WHEREAS, the City and Main Street Child Development Center executed a Second Amendment to Lease on April 3, 2003, extending the term of the Lease for an additional twelve months, to December 31, 2005; and WHEREAS, the City and Main Street Child Development Center desire to extend the term of the Lease for an additional six months, to June 30, 2006, in accordance with the terms and conditions set forth in the Third Amendment to Lease attached hereto. NOW, THEREFORE, BE IT RESOLVED by the City Council that the City Manager is authorized to execute a Third Amendment to Lease on behalf of the City extending the current Lease with Main Street Child Development Center, Inc., for approximately eight thousand (8,000) square feet of space in the former Green Acres Elementary School for an additional six months, to June 30, 2006. BE IT FURTHER RESOLVED that the Third Amendment to Lease shall be in the form attached hereto and made a part hereof.
