R-04-69 RESOLUTION TO APPROVE THE REQUEST OF D&L PAK ASSOCIATES, LLC, BY MYUNG OK KIM, AGENT, FOR A SPECIAL EXCEPTION TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES KNOWN AS 10090 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-((02))-147. WHEREAS, D&L Pak Associates, LLC, by Myung Ok Kim, agent, has submitted Application No. SE-781-04-1 requesting a Special Exception, pursuant to City Code Section 110-185, to allow a ground-mounted commercial building identification sign to display the names of two of the building's tenants; WHEREAS, City Council has carefully considered the application, the recommendation of the staff, and the testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by the City of Fairfax Code Sections 110-366 and 110-185 for the following reasons: 1) The proposed signage satisfies the Special Exception criteria set forth in the City's zonin regulations; 2) The architecture of the proposed signage generally conforms with the guidelines set in the Community Appearance Plan for signs located along commercial corridors; 3) The size of the proposed signage is less than what is permitted by right; 4) The proposed signage is not anticipated to affect the safety and movement of traffic on the subject property and along Main Street; and 5) City Council has previously approved Special Exception requests to allow the display ol tenant names on ground-mounted commercial business identification signs. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 12th day of October, 2004, that Application SE-781-04-1 be and hereby is APPROVED, WITH THE FOLLOWING CONDITIONS: 1. The brick surround on top of the sign structure shall be detailed with two courses of brick, but in no case shall the overall height of the proposed sign exceed six feet; 2. Any lighting for the proposed signage shall be externally illuminated; 3. Any landscaping in front of the proposed signage shall consist of a low ground cover; 4. The applicant shall install a deciduous tree measuring not less than 3 ½ inches in caliper, six inches above the ground level, in the landscape island where the proposed signage would be installed.
