A RESOLUTION IN SUPPORT OF LEGISLATION TO REQUIRE BUFFER
ZONES BETWEEN UNIVERSITY CONSTRUCTION PROJECTS
AND ADJACENT RESIDENTIAL COMMUNITIES.
WHEREAS, residents have expressed concern over expansion by George Mason
University of a parking lot adjacent to the Green Acres subdivision in the City of Fairfax; and
WHEREAS, currently there are no laws that require 4-year public institutions of
higher education to maintain minimum buffer zones adjacent to single-family residential
communities; and
WHEREAS, Delegate J. Chapman Petersen has introduced HB2030 in the 2003
General Assembly session to require the governing boards of each 4-year public institution of
higher education, in entering into any contracts for construction or expansion projects on and
after July 1, 2003, unless otherwise required by any applicable local zoning regulation or as
may be otherwise required by agreement with the relevant local governing body, to include in
any such contracts provisions ensuring the maintenance of a minimum buffer zone of trees,
shrubs, or other vegetation of at least 100 feet in depth where such projects are adjacent to
private communities that are zoned for single-family residential housing.
NOW, THEREFORE, BE IT RESOLVED, that the Fairfax City Council supports
HB2030 and encourages its passage by the 2003 General Assembly.
