A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO SETTLE THE
LAWSUIT AGAINST THE CITY BY ARRIVALSTAR, INC.
WHEREAS, on April 29, 2003, the City Manager was served with the a patent
infringement lawsuit filed by ArrivalStar, Inc., which arises from the City's purchase and use
of the Nextbus system; and
WHEREAS, the City of Fairfax and ArrivalStar, Inc. have entered into settlement
negotiations regarding the lawsuit, and have agreed upon the terms of settlement.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Fairfax, Virginia, that the City Attorney is authorized to settle the lawsuit against the City by
ArrivalStar, Inc., in accordance with the terms set forth in the confidential patent license and
settlement agreement, and that the City Attorney is authorized to execute any and all
documents on behalf of the City in connection with the settlement.
