20020122 r-02-2RESOLUTION NO. 2002 RESOLUTION TO APPROVE, WITH A CONDITION, THE REQUEST OF SHELL OIL COMPANY FOR A SPECIAL EXCEPTION, PURSUANT TO CITY CODE SECTION 110-185, TO INSTALL A GROUND-MOUNTED SIGN THAT EXCEEDS THE MAXIMUM PERMITTED SIGN AREA AND HEIGHT, AND IS LOCATED LESS THAN THE REQUIRED 20' SETBACK FROM THE PROPERTY LINE AT 9956 MAIN STREET. WHEREAS, Shell Oil Company has submitted Application No. SE-304-01-1 requesting a Special Exception pursuant to City Code Section 110-185; and WHEREAS, The City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, the City Council has determined that the proposed Special Exception, with a condition, is appropriate because the proposal meets the requisites established by City of Fairfax Code for the following reasons: The request meets the criteria established in City Code Section 110-366(3) and 110-185. The City Council has determined that the granting of a special exception will not be inconsistent with the Comprehensive Plan or the purpose of the sign regulations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this twenty-second of January, 2002 that Application No. SE-304-01-1 be and hereby is APPROVED WITH A CONDITION, as follows: The existing pylon sign and ground-mounted state inspection center sign shall be removed and replaced with the ground-mounted sign as detailed on the Special Exception Plan for 9956 Main Street, prepared by Monaco & Manganello Land Development Consultants, Inc. and dated January 7, 2002.
