20020528 r-02-20RESOLUTION NO. R-02-20 RESOLUTION TO APPROVE THE REQUEST OF THE ECKERD CORPORATION, BY DAVID S. HOUSTON, AUTHORIZED AGENT/ATTORNEY, FOR A SPECIAL EXCEPTION TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES KNOWN AS 9508 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 58-3-((02))-028A. WHEREAS, the Eckerd Corporation, by David S. Houston, Authorized Agent/Attorney, has submitted Application No. SE-317-02-1 requesting a Special Exception from City Code Section l10-180(b)(2)(a) to allow building-mounted tenant signage to be installed in a location other than the building frontage. WHEREAS, the City Council has carefully considered the application, the recommendation of the staff, and the testimony received at the public heating; and WHEREAS, the City Council has determined that the proposed Special Exception for sign location is appropriate because the proposal meets the requisites established by City Code Section 110-185 for the following reasons: 1. The request meets the criteria established in City Code Section 110-366; 2. The applicant has clearly demonstrated that the signage requirements will present a unique burden due to unusual topography, building design, or lot shape; and 3. The City Council has determined that the granting of this special exception will not be inconsistent with the Comprehensive Plan or the purpose of the sign regulations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this twenty-eighth day of May, 2002, that Application No. SE-317-02-1 be and hereby is APPROVED, WITH CONDITIONS, as follows: 1. Installation of the signage shall be in substantial conformance with the plans prepared by Chandler Signs, dated May 15, 2002. The applicant shall be permitted to install two signs reading "Eckerd" (with the corporate trademark "x" located below the letter "r") and "Pharmacy" along the front and side facades of the building. 3. The total square footage for the proposed signage shall not exceed 115.5 square feet. Adopted this 28th day of May, 2002.
