A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO SETTLE
THE LAWSUIT AGAINST THE CITY BY K&K PAINTING AND
CONSTRUCTION COMPANY FOR THE AMOUNT OF $50,000.00
WHEREAS, on September 20, 2001, the City of Fairfax was served with a lawsuit
filed by K & K Painting and Construction Company seeking $140,464.93 in damages related
to K&K's repair and painting of the Lyndhurst Water Tank; and
WHEREAS, the City of Fairfax and K&K Painting and Construction Company have
entered into settlement negotiations regarding the lawsuit, and K & K has agreed to settle the
case for $50,000;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Fairfax,
Virginia, that the City Attorney is authorized to settle the lawsuit against the City by K&K
Painting and Construction Company for the amount of $50,000.00, and that the City Attorney
is authorized to execute any and all documents on behalf of the City in connection with the
settlement.
