RESOLUTION TO APPROVE, WITH CONDITIONS, THE REQUEST OF RLM
FAIRFAX, LLC, BY ROBERT L, MENEFEE, PRESIDENT, FOR A SPECIAL
EXCEPTION FROM CITY CODE SECTION 110-180(b)(2) a.3 TO INSTALL A
GROUND-MOUNTED SIGN FOR ABBEY CARPET AND FLOORS ON THE
PREMISES KNOWN AS 9979 MAIN STREET AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 58-3-02-008.
WHEREAS, RLM FAIRFAX, LLC has submitted Application No. SE-335-02-1
requesting a Special Exception pursuant to City Code Section 110-185; and
WHEREAS, The City Council has carefully considered the application, the
recommendation of the staff and testimony received at the public heating; and
WHEREAS, the City Council has determined that the proposed Special Exception,
with conditions, is appropriate because the proposal meets the requisites established by City
of Fairfax Code for the following reasons:
1. The request meets the criteria established in City Code Section 110-366 and 110-185.
2. The City Council has determined that the granting of a special exception will not be
inconsistent with the Comprehensive Plan or the purpose of the sign regulations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this eighth day of October, 2002 that Application No. SE-335-02-1 be and hereby is
APPROVED WITH CONDITIONS, as follows:
1. The ground-mounted sign shall be installed in substantial conformance with the
submitted drawings prepared by Paciulli Simmons & Associates, dated August 5,
2002, and Sign Effects, dated July 18, 2002.
2. The location of the sign may be angled slightly to provide maximum visibility, but in
no case shall the sign be set back less than 10 feet from the front property line.
