A RESOLUTION TO INITIATE CONDEMNATION PROCEEDINGS FOR
APPROXIMATELY 3.28 ACRES OF PROPERTY HAVING ADDRESSES OF 9910
BARBARA ANN LANE, 9990 MOSBY ROAD, AND 4143 EVERGREEN DRIVE,
TAX MAP NUMBERS 58-3-02-001, 57-4-06-009E, AND 57-4-19-000-A, FOR
OPEN SPACE AND PUBLIC PARK PURPOSES.
WHEREAS, the City has determined that there is a public need for open space and a
public park on approximately 3.28 acres of property, having addresses of 9910 Barbara Ann
Lane, 9990 Mosby Road, and 4143 Evergreen Drive, on property owned by the Estate of June
Grefe and/or the heirs thereto; and
WHEREAS, in order to proceed with the acquisition of the property for open space
and public park purposes, the initiation of condemnation proceedings is necessary.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
that condemnation of a certain property having addresses of 9910 Barbara Ann Lane, 9990
Mosby Road, and 4143 Evergreen Drive, which property is owned by the Estate of June Grefe
and/or the heirs thereto, is necessary for the purpose of open space and public park land, and
staff is hereby authorized to initiate condemnation proceedings, including possession prior to
the conclusion of the condemnation proceedings, if necessary, in accordance with the law.
ADOPTED this 22nd day of October, 2002.
