20021112 r-02-56RESOLUTION- R-02-56 RESOLUTION TO APPROVE THE REQUEST OF TED BRITT FORD SALES, INC., FOR A SPECIAL EXCEPTION TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES KNOWN AS 11091 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 57-1-((2))-31 & PT. 3lA. WHEREAS, Ted Britt Ford Sales, Inc. has submitted Application No. SE-311-02-1 requesting a Special Exception to the City Code Section listed below: Section 110-258 New development and redevelopment in the I-2 District shall provide a 25-foot-wide landscaped strip planted with either a double row of evergreen trees, or a row of deciduous trees with two rows of large evergreen shrubs, and a six-foot-tall board-on-board screening fence where adjacent property is zoned C-2 or 1-2. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110-263 and Section 110-366 for the following reasons: 1. The proposed development is an interim use that will facilitate future redevelopment of the subject site in a manner consistent with the recommendations of the Comprehensive Plan. 2. The proposed development will not result in inadequate amenity on the subject site. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 12th day of November, 2002, that Application No. SE-311-02-1 be and hereby is APPROVED with the following conditions: 1. The applicant shall provide fencing, landscaping, and lighting as approved by the BAR on July 19, 2000. General Conditions 1. On or before December 12, 2002, the applicant shall provide surety in a form acceptable to the City to enable approval of the site plan. The applicant shall ensure that all improvements to the subject site necessitated by the City Council approval SE/SUP plan and development conditions are completed within six months after the currently pending application for a different, permanent use of the site has been denied, withdrawn, or otherwise ceases to be diligently pursued as determined by the Director of Community Development and Planning. However, in the event that an application for an alternative use or development of the property is approved by the City Council prior to that date, then the approval of such development or use may provide for a reasonable extension of the deadlines established herein. o By letter to the Zoning Administrator to be submitted no later than November 19, 2002, the applicant shall designate an individual as a point of contact with the City. Such individual shall be responsible for monitoring compliance with all City Code requirements as well as all conditions of approval applicable to the SUP/SE applications related to the subject properties. It is understood that failure to comply with the conditions of approval and the requirements of the City Code constitute grounds for revocation of the special use permits and/or special exceptions.
