20021112 r-02-57RESOLUTION - R-0 2-5 7 RESOLUTION TO APPROVE THE REQUEST OF TED BRITT FORD SALES, INC., FOR A SPECIAL EXCEPTION TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES KNOWN AS 11160 LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 57-1-((2))-PT. 3lA. WHEREAS, Ted Britt Ford Sales, Inc. has submitted Application No. SE-311-02-1 requesting a Special Exception to the City Code Section listed below: Section 110-259(a) - Each off-street parking area not adjacent to a public right-of-way shall be separated from the property line by a landscaped strip of not less than the width of the required setback for the zoning district within which such parking area is located, or twelve (12) feet in width, whichever is less, provided that a minimum of seven (7) feet in width shall be provided. Such landscaped strip shall be planted with at least one deciduous tree meeting the dimensional requirements contained in Section l10-259(a)(1)a, for every two hundred square feet of required landscaped strip. Each off-street parking area adjacent to a public right-of-way shall be separated from such right-of-way by a landscaped strip of not less than the width of the required building restriction area for the zoning district within which said parking area is located and shall contain an earthen berm, compact evergreen hedge or an equal or better alternative approved by the director and at least one deciduous tree not less than three and one-half inches in caliper for every 500 square feet of landscaped strip. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110-263 and Section 110-366 for the following reasons: The proposed development is an interim use that will facilitate future redevelopment of the subject site in a manner consistent with the recommendations of the Comprehensive Plan. The proposed development will not result in inadequate amenity on the subject site. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 12th day of November, 2002, that Application No. SE-311-02-1 be and hereby is APPROVED with the following conditions: General Conditions 1. On or before December 12, 2002, the applicant shall provide surety in a form acceptable to the City to enable approval of the site plan. The applicant shall ensure that all improvements to the subject site necessitated by the City Council approval SE/SUP plan and development conditions are completed within six months after the currently pending application for a different, permanent use of the site has been denied, withdrawn, or otherwise ceases to be diligently pursued as determined by the Director of Community Development and Planning. However, in the event that an application for an alternative use or development of the property is approved by the City Council prior to that date, then the approval of such development or use may provide for a reasonable extension of the deadlines established herein. o By letter to the Zoning Administrator to be submitted no later than November 19, 2002, the applicant shall designate an individual as a point of contact with the City. Such individual shall be responsible for monitoring compliance with all City Code requirements as well as all conditions of approval applicable to the SUP/SE applications related to the subject properties. It is understood that failure to comply with the conditions of approval and the requirements of the City Code constitute grounds for revocation of the special use permits and/or special exceptions.
