20010522 r-01-14RESOLUTION NO. 2001 - R-01-14 RESOLUTION TO APPROVE, WITH CONDITIONS, THE REQUEST OF POPE'S AUTO BODY AND PAINTING FOR A SPECIAL EXCEPTION FROM CITY CODE SECTION l10-155(b)(3)(b), PURSUANT TO SECTION 110-158, TO ALLOW A REDUCTION IN THE NUMBER OF REQUIRED PARKING SPACES ON THE PREMISES KNOWN AS 3159-B DRAPER DRIVE AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 48-3-10-006, WHEREAS, Pope's Auto Body and Painting, by W.W. Pope, President, has submitted Application No. SE-289-01-1 requesting a Special Exception to City Code Sections 110-155 (b)(3)(b), to allow a reduction in the number of required parking spaces. WHEREAS, The City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, the City Council has determined that the proposed Special Exception, with conditions, is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 110-366(3) and 110-158 for the following reasons: The request meets the criteria established in City Code Section 110-366(3). The applicant has clearly demonstrated that requirements contained in this division will present a unique burden due to unusual topography, building design, or lot shape. The City Council has determined that the granting of special exceptions will not be inconsistent with the Comprehensive Plan or the purpose of the City Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this twenty-second day of May, 2001, that Application No. SE-289-01-1 be and hereby is APPROVED WITH THE FOLLOWING CONDITIONS' No vehicles shall be parked outside the warehouse for more than 24 consecutive hours. No more than 7,141 square feet of the building shall be used for Pope's motor vehicle repair business. The remaining 16,094 square feet of space is to remain warehouse and storage.
