20010724 r-01-26RES OLUTION NO. 2001 - R- 01- 26 RESOLUTION TO APPROVE THE REQUEST OF PHILIP M. NACHMAN, LLC, BY ADTEK ENGINEERS, INC., AGENT, FOR SPECIAL EXCEPTIONS TO CHAPTER 110 OF THE CITY CODE ON THE PREMISES KNOWN AS 10855 LEE HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 57-1-((14))-35, 36, 37, AND 42A. WHEREAS, Philip M. Nachman, LLC, by ADTEK Engineers, Inc., Agent, has submitted Application No. SE-280-01-1 requesting a Special Exception to the following City Code sections: Section 110-259(a)- to reduce the required perimeter landscaping requirements for off-street surface parking areas. Section 110-153(3)- to allow a parking area to be separated from the building less than the required six feet. Section 110-155(a)(5)- to reduce the required dimensions of parking spaces. Section 110-155(b)(3)- to reduce the number of required off-street parking spaces. Section 110-783(5)(a)- to increase the required floor area ratio. WHEREAS, City Council has carefully considered the application, the recommendation of the staff, and the testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by the City of Fairfax Code Sections 110~366, 110-158, 110-263, and 110-783(6) for the following reasons: 2. 3. 4. 5. 6. 7. 8. 9. 10. It is generally consistent with the recommendations of the Comprehensive Plan and the Community Appearance Plan; It is appropriate for the size, shape, and location of the site; It would not have an adverse impact on the existing and planned use and development of adjacent properties; It would not have an adverse impact on the general public safety and welfare; It is in harmony with the general purpose and intent of the Zoning Ordinance and Section 15.2-2283 of the Code of Virginia; It would not result in increased traffic congestion or otherwise negatively impact existing traffic flow or pedestrian and vehicular safety; It is necessary to permit reasonable use of the property; It would not result in a development which is disproportionate to surrounding land uses in size, bulk, or scale; It would not result in the obstruction of light and air, danger and congestion in transportation, or increased danger from fire, flood, or other hazards; and It would not result in inadequate on-site amenities or any conditions that would adversely affect nearby property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 24th day of July, 2001, that Application No. SE~280-01-1 be and hereby is APPROVED with the following conditions: o o The applicant shall consolidate Tax Map Parcels 57-1-((14))-35, 36, 37, and 42A prior to site plan approval. The applicant shall remove the existing automatic teller machine building prior to obtaining a building permit. The applicant shall remove the existing ground-mounted business sign prior to obtaining a building permit. The proposed development shall be constructed in substantial conformance with the Special Exception/Special Use Permit Plan, dated May 15, 2001, prepared by ADTEK Engineers, Inc. The architectural elevations, dated February 28, 2001, prepared by Samaha Associates, P.C., are not approved as part of this review and must be submitted to the Board of Architectural Review for review and approval. It is understood that the building will reflect the predominant use of brick and glass as shown in these elevations with materials as architectural features and design elements only, such as precast or split-face concrete Prior to occupying the building, the applicant must apply for and receive a Nonresidential Use Permit and a Certificate of Occupancy. The applicant shall install signage prohibiting right tums for traffic exiting the site onto Walnut Street and left tums for traffic entering the site from Walnut Street.
