R-01-27 RESOLUTION FOR CREDITING SEWER CONSTRUCTION COSTS AGAINST WATER AND SEWER CONNECTION FEES FOR OWNER OF THE ADDITUR BUILDING ON JUDICIAL DRIVE WHEREAS, the sanitary sewers at the comer of Judicial Drive and Route 123 were budgeted for realignment as part of the city's Capital Improvement Program (CIP); and WHEREAS, the owner of the Additur Building has realigned the Judicial Drive portion of these sewers to benefit both the city and the Additur Building at a cost of approximately $120,000; and WHEREAS, the water and sewer connection fees for the Additur Building total $60,752.10, approximately one half of the total construction cost; and WHEREAS, the cost of the sewer realignment was twice as that budgeted by the owner of the Additur Building due to the many unanticipated conflicts during the construction; and WHEREAS, owner of the Additur Building has requested the city staff waive the water and sewer connection fees to defray the cost of unanticipated conflicts during the construction cost, which the city would have had to cover under its CIP; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax, that: The city shall credit the cost of the sanitary sewer improvements on Judicial Drive against the cost of the water and sewer connection fees for the Additur Building.
