R-00-1 RESOLUTION TO APPROVE THE REQUEST OF JAGUAR HOMES, INC., FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE TO ALLOW PARKING IN THE RESOURCE PROTECTION AREA BUFFER ON THE PREMISES KNOWN AS 10328 SAGER AVENUE, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-((2))- 132. WHEREAS, Jaguar Homes, Inc. has submitted Application No. SE-241-99-1 requesting a Special Exception to the City Code listed below: Section 26-19.1(b)(3) - For the purposes of retarding runoff, preventing erosion, and filtering nonpoint source pollution from runoff, a buffer area extending at least 100 feet adjacent to the stream or tributary shall be retained, if present, or established wherever such buffer does not exist. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-19.3 and Section 26-103(c) for the following reasons: 1. The proposed rezoning application and general development plan are consistent with the recommendations of the Comprehensive Plan for senior- friendly, residential development in the Transition District; 2. The proposed development provides measures to mitigate any potentially negative effect on water quality, and provides reasonable tree preservation given the urban character of Old Town. 3. The proposed development meets the purpose and intent of the PD District; and 4. The proposed development is consistent with the City's policies and vision for the redevelopment of the Old Town Fairfax. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 11th day of January, 2000 that Application No. SE-241-99-1 be and hereby is APPROVED with the following condition: Development in the RPA buffer area shall occur in a manner consistent with the General Development Plan/Preliminary Site Plan dated February 25, 1999 and amended through December 8, 1999.
