R-O0-2 RESOLUTION TO APPROVE THE REQUEST OF JAGUAR HOMES, INC., FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE TO EXCEED THE 43-FOOT MAXIMUM PERMITTED BUILDING HEIGHT, TO EXCEED THE 1.0 MAXIMUM FLOOR AREA RATIO FOR RESIDENTIAL USE, AND TO ALLOW THE TOTAL OF GROSS FLOOR AREA OF THE BUILDING AND THE ABOVE-GRADE HORIZONTAL SURFACE AREA OF THE STRUCTURED PARKING TO EXCEED 120% OF THE GROSS LOT AREA ON THE PREMISES KNOWN AS 10328 SAGER AVENUE, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-((2))-132. WHEREAS, Jaguar Homes, Inc. has submitted Application No. SE-241-99-1 requesting a Special Exception to the City Code listed below: Section 26-213.2(b)- No wall of any structure shall be exposed more than 43 feet above the finished grade. Section 26-213.2(e)(1) - A structure heaving a minimum of 33% of the gross floor area permanently dedicated to retail or residential use shall have a maximum floor area ratio of 1.0. Section 26-213.2(e)(2) - If structured parking is provided, the total of the gross floor area of the building and the above-grade horizontal surface area of the structured parking shall not exceed 120 percent of the gross lot area if residential uses are accommodated. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-213.2(0 and Section 26-103(c) for the following reasons: The proposed rezoning application and general development plan are consistent with the recommendations of the Comprehensive Plan for senior-friendly, residential development in the Transition District; The proposed pedestrian plaza areas, varying surface planes in the building's fagade, architectural details, and landscaping mitigate the impact of the building's length and height; o The proposed berming and screening along Sager Avenue and the proposed landscaping and tree preservation around the periphery of the proposed development are appropriate to mitigate adverse impacts; 4. The proposed development meets the purpose and intent of the Transition Overlay District; and 5. The proposed development is consistent with the City's policies and vision for the redevelopment of Old Town Fairfax. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 11th day of January, 2000, that Application No. SE-241-99-1 be and hereby is APPROVED with the following condition: Development in the RPA buffer area shall occur in a manner consistent with the General Development Plan/Preliminary Site Plan dated February 25, 1999 and amended through December 8, 1999.
