R-00-42 A RESOLUTION TO AUTHORIZE PROCEEDING WITH THE REQUIREMENTS TO PLACE AN ADVISORY REFERENDUM ON THE NOVEMBER 7, 2000 GENERAL ELECTION BALLOT, WITH RESPECT TO THE ACQUISITION OF LAND FOR USE AS OPEN SPACE OR PARK LAND. WHEREAS, Section 3.8 of the City Charter authorizes the City Council, by majority vote of the entire Council, to submit to the qualified voters of the City for advisory purposes any question relating to the affairs of the City; and WHEREAS, the City Council desires to submit to the qualified voters of the City, for advisory purposes, the question set forth below pertaining to the acquisition of land for use as open space or park land. NOW, THEREFORE, BE IT RESOLVED by the City Council that the City staff, in coordination with the General Registrar, shall take the necessary steps to have the following advisory referendum question placed on the November 7, 2000 General Election ballot: "Do you support the establishment of a dedicated fund in the City of Fairfax to purchase available land for the purpose of maintaining the land as open space or park land, with that fund provided through an increase of up to five cents in the real property tax rate for a period of not greater than five years?" BE IT FURTHER RESOLVED that the results of this advisory referendum shall be non-binding upon the City. BE IT FURTHER RESOLVED that (1) no City government funds shall be spent on informational brochures, mailings, pamphlets, flyers, outreach meetings, special mailings and/or advertisements concerning this advisory referendum on or before November 7, 2000; (2) the City Manager and the City staff shall, in their official capacities, remain neutral as to whether the advisory referendum should be approved or rejected, just as the City Manager and the City staff remain neutral, in their official capacities, as to whether candidates for City office should be elected or not; and (3) the only official notice of the advisory referendum shall be in the Cityscene and on the Cityscreen (Cable Channel 12), with the following wording: "On Tuesday, November 7, 2000, the following advisory referendum will be on the general election ballot: "Do you suport the establishment of a dedicated fund in the City of Fairfax to purchase available land for the purpose of maintaining the land as open space or park land, with that fund provided through an increase of up to five cents in the real property tax rate for a period of not R-00-42 -2 greater than five years?" This notice shall appear in normal font in the two Cityscene editions immediately preceding the November 7, 2000 general election. ADOPTED this 25t~ day of July, 2000.
