AMENDMENTS TO THE CITY CODE REGARDING FRONT AND SDE YARD
SETBACKS IN RESIDENTIAL DISTRICTS, SITE PLANS AND
RESOLUTION TO REFER TO THE PLANNING COMMISSION MINOR SITE
PLANS, AND MINOR ENLARGEMENTS OF NONCONFORMING USE
WHEREAS, current City Code minimum front and side yard requirements, site
plan requirements, and restrictions on the enlargement of nonconforming uses inhibit the
revitalization efforts to achieve quality development and redevelopment within the City
of Fairfax;
WHEREAS, the City Code regulations regarding minimum side and front yard
requirements in the R-1, R-2, and R-3 Residential Districts should be revised to facilitate
improvements promoted by the Comprehensive Plan goals and objectives, and the
recommendations of the Final Report of the Task Force for a More Livable City of
Fairfax; and
WHEREAS, the City Code regulations regarding the requirements for site plans
and nonconforming uses should be revised to facilitate improvements promoted by the
Comprehensive Plan goals and objectives;
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of
Fairfax, Virginia, refers to the Planning Commission for study, public hearing, and
recommendation, four proposed text amendments to City Code Chapter 26 as stated
above.
