RESOLUTION TO APPROVE THE REQUEST OF HHH FAIR CITY,
LLC, FOR A SPECIAL EXCEPTION TO CHAPTER 110 OF THE CITY
CODE TO ALLOW A REDUCTION OF THE REQUIRED NUMBER OF
PARKING SPACES FOR A SHOPPING CENTER; ELIMINATE THE
REQUIRED SIX-FOOT-WIDE SEPARATION BETWEEN PARKING
SPACES AND A STRUCTURE; AND TO MODIFY THE REQUIRED
INTERIOR PARKING LOT LANDSCAPING ON THE PREMISES
KNOWN AS 9600 THROUGH 9688 MAIN STREET (FAIR CITY
MALL), AND MORE PARTICULARLY DESCRIBED AS TAX MAP
PARCEL 58-3-((2))-23A.
WHEREAS, HHH Fair City Mall, LLC, has submitted Application No. SE-271-00-
1 requesting a Special Exception to the City Code listed below:
Section 110-155(b) - off-street parking spaces shall be provided in
accordance with the following minimum standards:
shopping centers and multiple use developments shall
provide off-street parking equivalent to the sum of
the required parking of the individual uses located
therein.
Section 110-153(3) - parking spaces adjacent to structures shall be
separated from such structure by a sidewalk,
landscaped strip, or combination thereof not less than
six feet in width.
Section 110-259(a)(2) - within parking areas containing more than 25
spaces, planting islands shall be provided at each end
of each parking bay.
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Section 110-158, Section 110-263 and Section 110-366(3) for the following reasons:
1. Will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and
vehicular safety.
2. Will not be contrary to the objectives specified in the
Comprehensive Plan.
3. Is necessary to permit the reasonable use of the subject property.
4. Will not result in inadequate on-site amenity; and
5. Will not adversely impact adjacent property or the surrounding
area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 12th day of December, 2000, that Application No. SE-271-00-1 be and
hereby is APPROVED with the following conditions:
Development shall be consistent with the Special Exception
Plat dated September, 2000 and revised through December 4,
2000, with revisions to include a landscaped island at each
end of the parking row adjacent to the rear wall of the fitness
facility.
The applicant shall encourage all employees of businesses
located in Fair City Mall, including those in the free-standing

buildings, to park in the remote parking areas located behind
the shopping mall.
The applicant shall ensure that security measures are installed
to provide proper surveillance and protection of employees
that park in the remote parking areas behind the shopping
mall.
The applicant shall ensure that additional dumpsters are not
placed on the subject site unless they are contained in the
existing dumpster enclosures. Any temporary construction
dumpsters or other "roll-off" dumpsters necessary for new
construction must be removed as soon as feasible, but in no
case later than 15 days from the date of completion of that
construction.
The applicant shall, prior to development plan approval for
the parking lot modifications, provide a city-standard shelter,
bench and map holder for the CUE bus stop located on
Pickett Road at the signalized entrance to Fair City Mall,
subject to review and approval by the Director of Public
Works.
The applicant shall, prior to development plan approval for
the parking lot modifications, provide acorn-style street lights
along Pickett Road and Main Street in accordance with City
standards.
The applicant shall provide daily monitoring of the dumpster
enclosures along the service drive behind the mall to ensure
that lids are closed, dumpsters are located within the confines
of the enclosures and refuse is placed inside the dumpsters.
The applicant shall obtain architectural approval for all
existing and future dumpster enclosures. Dumpsters shall not
be permitted unless located in enclosures as required by City
Code.
The applicant shall work with the Comstock community
association to determine a more substantial material for solid
screening wall or fence (to replace all or a portion of the
existing wood screening fence) between the shopping center
and the Comstock community, subject to approval by the
Board of Architectural Review.
