RESOLUTION TO APPROVE THE REQUEST OF SECOND
AMERICANA ASPEN LIMITED PARTNERSHIP, FOR SPECIAL
EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON TIlE
PREMISES KNOWN AS 1 ! 001 LEE HIGHWAY, AND MORE
PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-1-((2))-
128.
WHEREAS, SECOND AMERICANA ASPEN LIMITED
PARTNERSHIP, has submitted Application No. SE-233-98-1&2 requesting
Special Exceptions to the City Code sections listed below:
Section 26-39.5(b)(2)-
to allow reduction of the
required number of loading
spaces.
Section 26-68 and 26-69(a)(1)(a)-
to allow the existing
landscaping along Park Road
to remain without the
addition of a fence or of
deciduous landscape
materials.
WHEREAS, City Council has carefully considered the application, the
recommendation of the staff and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special
Exceptions are appropriate because the proposal meets the requisites established
by City of Fairfax Code Section 26-71.2, Section 26-39.7 and Section 26-103(c)
for the following reasons:
Is consistent with the recommendations of the
Comprehensive Plan and the Community Appearance Plan:
2. Will not result in inadequate on-site amenity;
3. Will not have a negative effect on nearby properties;
Will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and
vehicular safety; and
WHEREAS, City Council established conditions for fencing and
landscaping with the concurrent Special Use Permit Application No. SLIP-1450-
98-1,3&4;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairfax on this 234 day of February, 1999, that Application No. SE-233-98-1 to
allow a reduction of the required number of loading spaces is APPROVED.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City
Council of the City of Fairfax on this 23ra day of February, 1999, that Application
No. SE-233-98-2 be and hereby is APPROVED with the following conditions:
Development and use of the subject site shall be in conformance
with the conceptual development Plan revised through January 21,
1999, as revised by these conditions and as necessary to fulfill site
plan requirements. Subsequent changes in uses on the property
shall be permitted, provided that such changes comply with
applicable City regulations.

The establishment of a brick pier with board on board fencing or
other appropriate materials so selected by staff along Park Street
with special care taken to minimize damage to the existing trees
and maximize aesthetics to the residential community.
The applicant shall construct a six-foot wall/fence with material to
be determined by the staff along Chestnut Street from Lee
Highway to the entrance of the development.
