RESOLUTION TO APPROVE THE REQUEST OF VIRGINIA
COMMERCE BANK, BY LAURIE P. BARNWELL, EXECUTIVE
VICE PRESIDENT, FOR A SPECIAL EXCEPTION TO MODIFY
CITY CODE SECTION 26-44, TABLE II, TO ALLOW THE
CONSTRUCTION OF A SECOND GROUND-MOUNTED SIGN ON
PROPERTY LOCATED AT 10777 MAIN STREET AND FURTHER
IDENTIFIED AS TAX MAP PARCEL 57-1-((2))-125A.
WHEREAS, Virginia Commerce Bank, by Laurie P. Bamwell,
Executive Vice President, has submitted Application No. SE-237-98-1
requesting a Special Exception to modify city code section 26-44, Table II to
allow display of a second ground-mounted; and
WHEREAS, City Council has determined that the proposed Special Exception
is appropriate because the proposal meets the requisites for approval of special
exceptions established by City of Fairfax Code Sections 26-48 and Section 26-103(c)(1-
13);
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 27~ day of April, 1999, that Application No. SE-237-98-1 be and
hereby is APPROVED with the following conditions:
The applicant shall submit plans for the design of the sign structure to the Board
of Architectural Review (BAR) for approval by BAR or its designee as being
similar in appearance to the existing "Kelly Square" ground-mounted sign on
the property;
The location of the sign shall be generally as shown on the plan submitted with
the special exception application;
The sign area shall be limited to 40 square feet, and the sign structure shall be
set back a minimum of 10 feet from all property lines; and
This special exception is approved only for one sign for a financial institution
occupying space on the subject property. If a period of one year should ever
pass during which no on-site financial institution legally maintains a sign permit
for this sign, the sign must be removed at the expense of the property owner.
A final location of Virginia Commerce Bank sign shall be compatible with other
existing signs at this location to ensure that visibility of the church sign is not
obstructed.
