RESOLUTION TO APPROVE THE REQUEST OF TED BRITT FORD
SALES, INC., FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE
CITY CODE TO ALLOW MODIFICATION OF THE TRANSITIONAL
SCREENING REQUIREMENTS ON THE PREMISES KNOWN AS
11091 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS
TAX MAP PARCELS 57-1-((2))-31 & PT. 3lA.
WHEREAS, Ted Britt Ford Sales, Inc. has submitted Application No. SE-243-99-1
requesting a Special Exception to the City Code Section listed below:
Section 26-68(a) - New development and redevelopment in the I-2 District
shall provide a 25-foot-wide landscaped strip planted
with either a double row of evergreen trees, or a row of
deciduous trees with two rows of large evergreen
shrubs, and a six-foot-tall board-on-board screening
fence where adjacent property is zoned C-2 or I-2.
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 23rd day of November, 1999, that Application No. SE-243-99-1 be and
hereby is APPROVED with the following conditions:
1. The applicant shall either replace the existing chain link fence topped
with barbed wire with a six-foot-tall board-on-board wood screen
fence (no masonry or brick piers will be required) between the I-2
portions of the subject site and the adjacent property identified by tax
map number 57-1-((33))-30 or, as an alternative, provide the
additional landscaping as shown on the SE/SUP plat. It shall be
understood that existing trees and shrubs may be retained in favor of
new landscaping where existing vegetation is positioned to serve the
same purpose as proposed plantings shown on the SE/SUP plat.
The applicant shall either install a six-foot-tall board-on-board wood
screen fence (no masonry or brick piers will be required) along the
northern property line of the 1-2 portion of the subject site where it
abuts the adjacent property identified as tax map number 57-1-((2))-27
or, as an alternative, provide the existing additional landscaping as
shown on the SE/SUP plat. Such fence, if provided, shall be located
immediately adjacent to the existing parking lot pavement so that the
existing landscaped strip is to the benefit of the adjacent property
identified as tax map number 57-1-((2))-27 and visible from Main
Street. It shall be understood that existing trees and shrubs may be
retained in favor of new landscaping where an existing tree or shrub is
positioned to serve the same purpose as proposed plantings shown on
the SE/SUP plat.
The applicant shall provide three (3) City standard acorn-style lights
along the Lee Highway property frontage and one (1) City standard
acorn-style light on the Main Street property frontage and shall
provide plantings on the subject site along such street frontages
consistent with the SE/SUP plan dated April 1999, revised through
October 1999 and prepared by Bengtson, DeBell and Elkin, Ltd.,
subject to approval by the Board of Architectural Review (BAR).
However, it shall be understood that the sidewalk will be maintained
in its current locations with respect to Lee Highway and Main Street to
ensure continuity with adjacent properties.
The applicant shall ensure that the SE/SUP plan prepared by Bengtson,
DeBell and Elkin, Ltd., dated April, 1999, and revised through
October, 1999, is further revised to reflect the necessary changes
generated by these conditions and submitted for review and approval
by the Zoning Administrator at the time of site plan submission.

5. The applicant shall submit to the Zoning Administrator for review and
approval a revised site plan for the subject site consistent with the
approved development conditions for SE-243-99-1 and SU- 1453-99-4
within 90 days from the date of the approval of the special exceptions
and special use permits. The applicant shall diligently pursue site plan
approval through the comment and revision phase of the site plan
review process.
6. The applicant shall ensure that all improvements to the subject site
necessitated by the City Council approved SE/SUP plan and
development conditions are completed within nine months from the
date of site plan approval.
