19980428 r-98-19RESOLUTION NO. 1998 - R-98-19 RESOLUTION TO DENY THE REQUEST OF OJB/AJRE JOINT VENTURE, LIMITED LIABILITY CORPORATION, BY STUART SCHOOLER, MANAGING MEMBER, FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 11015 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-1-((2))-037. WHEREAS, OJB/AJRE Joint Venture, Limited Liability Corporation has submitted Application No. SE-212-97-1 requesting a Special Exception to the City Code sections listed below: Sections 26-173(c) and (d) - to allow a 15-foot-wide front yard on Main Street and a 23.18-foot-wide front yard on Lee Highway where 25-foot-wide front yards are required, and to provide 22% landscaped open space where 25% is required; and Sections 26-39.4 and 26-39.5 to allow 8.5-foot-wide parking spaces where 9-foot-wide spaces are required and to eliminate the required loading space; and Section 26-69(a)(1) - to allow elimination of some of the required interior and perimeter parking lot landscaping; and Section 26-43(a)(3) - to allow reduction of the required 1 O-foot-wide setback for ground-mounted signage on an arterial street. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exceptions are not appropriate because the proposal does not meet the requisites established by City of Fairfax Code Sections 26-173(0, 26-39.7, 26-71.2, 26-48 and Section 26-103(c) for the following reasons: 1. The proposed development is not consistent with the recommendations of the Comprehensive Plan and Community Appearance Plan. The proposed development is based on a site plan that is inconsistent with the purpose and intent of the applicable provisions of the City Code as follows: a. Adequate on-site facilities for safe vehicular movement and parking are not provided. bo Environmental and aesthetic features to compensate for the requested reductions of setbacks, landscaping and open space are not provided. c. The special exception requests are not necessary to permit the reasonable use of the subject property. R-98-19 -2 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 28th day of April, 1998, that Application No. SE-212-97-1 be and hereby is DENIED.
