RESOLUTION TO APPROVE THE REQUEST OF SAUL HOLDINGS
LIMITED PARTNERSHIP, FOR A SPECIAL EXCEPTION TO
CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS
10710 I EE HIGHWAY, A rr) MORE PARTICUL Um ¥ DESCPaBED
AS TAX MAP PARCEL 57-1-((2))-60.
WHEREAS, Saul Holdings Limited Partnership, has submitted Application No.
SE-232-98-3 requesting a Special Exception to the City Code sections listed below:
Section 26-39.4(b) - to allow reduction of the required
number of parking spaces;
Section 26-68(a) - to allow reduction of the required
landscaped screening,;
Section 26-69(a)(1) and (2) - to allow reduction of the
required perimeter and interior parking
lot landscaping
WHEREAS, City Council has carefully considered the application, the
recommendation of the staff and testimony received at the public hearing; and
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Section 26-71.2, Section 26-39.7 and Section 26-103(c) for the following reasons:
Is consistent with the recommendations of the
Comprehensive Plan and the Community Appearance Plan;
2. Will not result in inadequate on-site amenity;
3. Will not have a negative effect on nearby properties;
Will not result in increased traffic congestion or otherwise
negatively impact existing traffic flow or pedestrian and
vehicular safety.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 13~h day of October, 1998, that Application No. SE-232-98-3 be and hereby
is APPROVED with the following conditions:

The applicant will provide prior to site plan approval for the
Shops at Fairfax to the City an agreement between the Shops at
Fairfax and the Boulevard Shopping Center to ensure that
neither property shall prohibit the parking of overflow
customer vehicles from the adjacent site. The applicant shall
ensure that future redevelopment of the Boulevard Shopping
Center and the Danker property, while under common
ownership, will include a traffic impact and parking analysis
that considers the effect of any redevelopment on the Shops at
Fairfax, subject to review and approval by the Director of
Community Development and Planning.
Replace the existing shrubs along the boundary with the
Memhant's Tire and Auto Center with screening shrubs to
provide at a minimum a three-foot-tall dense evergreen screen,
subject to approval by the Board of Architectural Review.

Provide the required street trees along Lee Highway adjacent
to, but not within, the 15-foot-wide dedication area along the
frontage of the subject site; however, the acorn street lights
shown on the site plan, shall be provided in the grass strip
between the sidewalk and the back of the curb on Lee
Highway.
A minimum of 300 parking spaces shall be maintained on the
property.
