RESOLUTION TO APPROVE THE REQUEST OF 11123 LEE
HIGHWAY ASSOCIATES, BY SOL SUSLOVICH, GENERAL
PARTNER, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF
THE CITY CODE ON THE PREMISES KNOWN AS 11123 LEE
HIGHWAY, AND MORE PARTICULARLY DESCRIBED AS TAX
MAP PARCEL 57-2-((2))-140.
WHEREAS, 11123 Lee Highway Associates, by Sol
Suslovich, General Partner, has submitted Application SE-
190-97-2 requesting special exceptions to the City Code
listed below:
Section 26-44(b) (2)a.1 to allow a shopping center
identification sign that exceeds the sign area
restrictions and to identify the individual businesses
located in the Pier 1 Center.
Section 26-44 Table II to allow a ground-mounted
business sign within the required setback permitted by
the city code.
WHEREAS, City Council has determined that the proposed
special exception to Section 26-44(b) (2)a.1 to allow a
fifty-four square-foot shopping center identification sign
that exceeds the area permitted by City Code and the
proposed special exception to Section 26-44 Table II to
allow a ground-mounted business sign within the required
setback are appropriate because the applicant has
demonstrated that the requirements of this chapter are
impractical.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Fairfax on this 25th day of March, 1997, the
special exceptions to Section 26-44(b) (2)a.1 and to Section
26-44 Table II to allow a fifty-four square-foot shopping
center identification sign to identify individual businesses
and set back ten feet from the right-of-way of Lee Highway,
as proposed by Application SE-190-97-2, be and hereby is
APPROVED.
