19970624 r-97-27RESOLUTION R-97-27 RESOLUTION TO APPROVE THE REQUEST OF PATRICK J. SHOOLTZ, CONTRACT PURCHASER, FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 3179 DRAPER DRIVE, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 48-3- ((10))-13. WHEREAS, Patrick J. Shooltz has submitted Application No. SE-197-97-1 requesting a Special Exception to the City Code listed below: Section 26-39.4 - To allow 52 parking spaces where 107 are required. Section 26-68(a) - To allow only a 25-foot-wide landscaped strip where both a screening fence and landscaped buffer are required along the south property line, and to eliminate the landscaped buffer and screening fence required along the north and east property boundaries. Section 26-39.2(c) - To eliminate the required separation between structures and adjacent parking spaces, and drive aisles, where six- foot-wide and four-foot-wide separations, respectively, are required. WHEREAS, City Council has carefully considered the application, the recommendation of the staff and testimony received at the public hearing; and WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Sections 26-39.7, 26-71.2 and Section 26-103(c) for the following reasons: Is consistent with the recommendations of the Comprehensive Plan; Will not result in increased traffic congestion or otherwise negatively impact the existing traffic flow or pedestrian and vehicular safety; o Is necessary to permit the reasonable use of the subject property and will not adversely impact adjacent property or the surrounding area; Presents an extraordinary circumstance because of its unique design; and, 5. Will not result in inadequate on-site amenities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 24th day of June, 1997, that Application No. SE-197-97-1 be and hereby is APPROVED with the following conditions: The applicant shall plant deciduous trees in the buffer area between the proposed building and the Horizon Bank property that shall be of a species that will mature to a height greater than the existing stockade fence on the bank property. The applicant shall plant supplemental evergreen trees in the buffer area adjacent to the Sizzler Restaurant site, in addition to the proposed R-97-27 -2 trees, in lieu of the required screening fence. In addition to the proposed deciduous trees, the applicant shall install in the buffer area adjacent to the Sizzler Restaurant site, supplemental evergreen trees, berms, shrubs, annual and perennial flowers or such other landscaping features as may be approved by the Board Architectural Review in lieu of the required screening fence. The applicant shall provide an interior roof drain system to ensure that run-off from the roof of the proposed building will not be directed toward the adjoining properties. The applicant shall use textured block, brick, stamped masonry or material of similar or better aesthetic quality on the north and east building facades subject to review and approval by the Board of Architectural Review. All applicable conditions shall be installed prior to issuance of certificate of occupancy; provided, however, that the Zoning Administrator may grant a single extension, not to exceed six months in duration, for the installation of plant materials, only if weather dictate such extension.
