RESOLUTION NO. R-96-6
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF FAIRFAX, VIRGINIA IN SUPPORT OF
THE REQUEST OF PATHWAY VISIONS, INC. FOR
EXEMPTION BY DESIGNATION FROM REAL
PROPERTY TAXATION PURSUANT TO ARTICLE X,
SECTION 6(a)(6) OF THE CONSTITUTION OF
VIRGINIA, AND VIRGINIA CODE SECTION 30-
19.04.
WHEREAS, Pathway Visions, Inc. ("Pathway"), a non-
profit corporation organized under the laws of the
Commonwealth of Virginia and exempt from federal taxation
under Section 501(c) of the Internal Revenue Code of 1954,
requested that the City Council of the City of Fairfax,
Virginia (the "Council") adopt a resolution supporting a
request to the General Assembly of Virginia to designate the
real property owned by Pathway in the City of Fairfax,
Virginia (the "City") to be exempt from local taxation,
pursuant to Article X, Section 6(a) (6) of the Constitution
of Virginia, and Virginia Code Section 30-19.04; and
WHEREAS, Pathway presently does not own real property
located in the City, but is expected to acquire real
property in the city with a total assessed value of
$146,300.00. The annual amount of real property taxes
regarding such property is estimated to be $1,418.61, which
represents 0.000081 of the City's current annual real
property tax revenue; and
WHEREAS, pursuant to Virginia Code Section 30-19.04,
notice has been given concerning such request and, on
February 13, 1996, a public hearing was held by the City
Council concerning the request; and
WHEREAS, the provisions of Virginia Code Section 30-
19.04 B. have been examined and considered by the City
Council; and

WHEREAS, the City Council supports the request of
Pathway for exemption from real property taxation and the
City Council recommends to the General Assembly that Pathway
be classified as charitable and benevolent within the
context of Article X, Section 6(a) (6) of the Constitution of
Virginia.
NOW, THEREFORE, BE IT RESOLVED that, having examined
and considered the provisions of Virginia Code Section 30-
19.04, and after notice and a public hearing, the City
Council of the City of Fairfax, Virginia hereby supports the
request of Pathway Visions, Inc. to the General Assembly of
Virginia to exempt from local taxation of real property
within the City, which real property is owned and used by
Pathway for charitable and benevolent purposes; and
BE IT FURTHER RESOLVED that the City Council recommends
that Pathway visions, Inc. be designated as a charitable and
benevolent organization within the context of Article X,
Section 6(a) (6) of the Constitution of Virginia; and
BE IT FURTHER RESOLVED that Pathway shall promptly pay
to the City the cost of publication of the notice for the
public hearing related to the consideration of this
Resolution.
