19960213 r-96-8RESOLUTION NO. R-96-8 RESOL~ION TO APPROVE THE REQUEST OF CROWN STATIONS, INC. BY JERRY WEDER, AGENT, FOR SPECIAL EXCEPTIONS TO CITY CODE SECTION 26- 69(a)(la) - TO ALLOW A LANDSCAPED STRIP ADJACENT TO A PUBLIC RIGHT-OF- WAY TO BE LESS THAN THE REQUIRED 25 FEET; SECTION 26-173(d) TO ALLOW THE LANDSCAPED OPEN SPACE TO BE LESS THAN THE REQUIRED 25 PERCENT OF THE DROSS AREA OF THE LOT; AND SECTION 26-39.1(h)(2) TO ALLOW THE INCREASE IN OFF-STREET PARKING (MORE THAN 30 PERCENT) FOR A NONCONFORMING USE WITHOUT REQUIRING THE ENTIRE SITE TO COMPLY WITH ALL APPLICABLE PROVISIONS OF THE PARKING ORDINANCE ON THE PREMISES KNOWN AS 10800 LEE HIGHWAY, AND MORE PARTICULARLY IDENTIFIED AS 57-1- ((2))-52. WHEREAS, Crown Stations, Inc. has submitted Application No. SE-170-96-2 requesting Special Exceptions to the City Code listed below: Section 26-69(a)(la) - To allow a landscaped strip adjacent to a public right-of-way to be less than the required 25 feet; Section 26-173(d) - To allow the landscaped open space to be less than the required 25 percent of the gross area of the lot; and Section 26-39. l(h)(2) - To allow the increase in off-street parking (more than 30 percen0 for a nonconforming use without requiting the entire site to comply with all applicable provisions of the parking ordinance. WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-39.7, Section 26.71.2 and Section 26-168(0 for the following reasons: 1. The proposed redevelopment enhances the appearance of the site and the Lee Highway Corridor. 2. The proposed design promotes the safety and movement of vehicular traffic on the site and upon adjacent streets. 3. Overall, the request is consistent with the purpose of the Zoning Ordinance and goal of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on of February, 1996, that Application No. SE-170-96-2 be and hereby is this 13th day APPROVED. ~~YOR ATI~EST:
