MILES, DIRECTOR, FOR SPECIAL EXCEPTIONS TO CITY CODE: SECTIONS 26-43(a)(3) AND (8) - TO ALLOW A GROUND-MOUNTED SIGN WIT] AN AREA GREATER THAN 40 SQUARE FEET TO BE SET BACK LESS THAN THE REQUIRED 20 FEET FROM THE PROPERTY LINE; SECTION 26-43(b)(2) - TO ALLOW INTERNALLY ILLUMINATED GROUND- MOUNTED SIGNS TO BE LOCATED WITHIN A RESIDENTIALLY-ZONED DISTRICT; AND SECTION 26-44(a) (TABLE I AND II) - TO ALLOW THE TOTAL SIGN AREA TO! EXCEED 32 SQUARE FEET AND TO ALLOW AN ADDITIONAL GROUND-i MOUNTED SIGN; AS PRE~ENTED IN APPLICATION SE-175-96-3, WITH THE CONDITION THAT THE SECOND GROUND-MOUNTED SIGN (SIGN #3) NOT TO EXCEED 12 SQUARE FEET AND APPROPRIATELY LANDSCAPED TO SHIELD LIGHTING FROM THE ADJACENT RESIDENCES, BE RELOCATED TO THE NEW UNIVERSITY DRIVE ENTRANCE SUBSEQUENT TO ITS COMPLETION, ON THE PREMISES KNOWN AS 4315 CHAIlX BRIDGE ROAD, BECAUSE THE REQUEST IS CONSISTENT WITH REQUISITF_2 ESTABLISHED IN CITY CODE SECTION 26-103(c) AND SECTION 26-48. WHEREAS, Access Emergency Care, Inc. has submitted Application No. SE-175-96- requesting Special Exception to the City Code listed below: Section 26-43(a)(3) and (8) - to allow a ground-mounted sign with an area greater than 40 square feet to be set back less than the required 20 feet from the property line; Section 26-43(b)(2) - to allow internally illuminated ground-mounted signs to be located within a residentially-zoned district; and Section 26-44(a) (Table I and II) - to allow the total sign area to exceed 32 square feet and to allow an additional ground-mounted sign; WHEREAS, City Council has determined that the proposed Special Exception is appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-103(c) and Section 26-48 for the following reasons: The relocation of the existing ground-mounted sign enhances visibility of this facility along the Chain Bridge Road for individuals in need of medical care. These sign mitigate problems in readily identifying these facilities because of the unusual building design, lot shape, building set back and mature vegetation. These sign promote the public welfare and the safe movement of vehicular traffic upon adjacent streets. m R-96-17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 14th day of May, 1996, that Application No. SE-175-96-3 be and hereby is APPROVED with the condition that the second ground-mounted sign (Sign #3), not to exceed 12 square feet and appropriately landscaped to shield lighting from the adjacent residences, be relocated to the new University Drive entrance subsequent to its completion.
