19960528 r-96-18RESOLUTION NO. R-96-18 RESOLUTION TO APPROVE THE REQUEST OF WESTERN EXTERMINATING COMPANY, INC. BY MICHAEL J. GIGUERE, ATTORNEY/AGENT, FOR A SPECIAL EXCEPTION TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS WESTERN TERMITE AND PEST CONTROL, 10843 AND 10849 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCELS 57-1-((21))-12, 13, 14, 15, 16, 17, 18, 19, 20 AND 21. WHEREAS, Western Exterminating Company, Inc., by Michael J. Giguere, Agent, has submitted Application No. SE-174-96-1 requesting Special Exceptions to the City Code as listed below: Section 26-173(c)(1) - To allow an 11.5-foot-wide front yard setback where a 25-foot-wide minimum setback is required; Section 26-39.2(c) - To eliminate the required six-foot-wide separation between parking spaces and structures, and to eliminate the required four- foot-wide separation between parking lot drive aisles and structures; and, Section 26-39.5(a)(5) - To allow an 18-foot-wide drive aisle where a 23-foot- wide drive aisle is required. WHEREAS, City Council has determined that the proposed Special Exceptions meet the requisites established by City of Fairfax Code Section 26- 173(f), Section 26-39.7 and Section 26-103(c) and are appropriate because the proposal: Will not result in a development which is disproportionate to surrounding land uses in size, bulk, or scale; 2. Will not adversely affect any nearby residential areas; o Will not overburden the community facilities existing or available or result in the obstruction of light and air, danger and congestion in transportation, or increased danger from fire, flood, or other hazards; o Will not be contrary to the objectives specified in the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 28th day of May, 1996, that Application No. SE-174-96-1 be and hereby is APPROVED with the following conditions: R-96-18 Parcels 57-1-((21))-12, 13, 14, 15 and 16 (Western Termite and Pest Control) shall be consolidated with parcels 57-1-((21))-17, 18, 19, 20 and 21 (service station) to form one parcel. Development of the site shall be in general conformance with the preliminary site plan submitted November 28, 1995 and revised through April 30, 1996. o The existing Western Termite pylon sign shall be removed and replaced with a ground-mounted sign as shown on the site plan. The existing pylon flood lights and public telephone booth shall be removed. Prior to building permit approval, the applicant shall coordinate with the Department of Public Works to develop an access easement agreement for the traffic signal pylon and controller box located on the Western Exterminating Company, Inc. property at the intersection of Main Street and Woodland Drive. The applicant shall ensure that all service vehicles and employee vehicles are parked on-site. A minimum of four acorn-style street lights shall be installed by the applicant along the Main Street frontage of the subject property prior to final building inspections. ATTEST: ~ity ~.lerk
