A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FAIRFAX,
VIRGINIA, IN SUPPORT OF THE REQUEST OF THE COUNTRY CLUB
HILLS RECREATION CORPORATION FOR EXEMPTION BY DESIGNATION
FROM REAL PROPERTY TAXATION PURSUANT TO ARTICLE X,
SECTION 6(a)(6) OF THE CONSTITUTION OF VIRGINIA, AND
VIRGINIA CODE SECTION 30-19.04.
WHEREAS, the Country Club Hills Recreation Corporation
(CCHRC), a non-profit corporation organized under the laws of the
Commonwealth of Virginia requested that the City Council of the
City of Fairfax, Virginia (the "Council") adopt a resolution
supporting a request to the General Assembly of Virginia to
designate the real property owned by CCHRC in the City of Fairfax,
Virginia (the "City") to be exempt from local taxation pursuant to
Article X, Section 6(a) (6) of the Constitution of Virginia, and
Virginia Code Section 30-19.04; and
WHEREAS, CCHRC presently owns two parcels of real estate
located in the City with a total assessed value of $251,500. The
annual amount of real property taxes regarding such property is
$2,489.85, which represents .00013666% of the City's current annual
property tax revenue; and
WHEREAS, pursuant to Virginia Code Section 30-19.04, notice
has been given concerning such request and, on December 10, 1996,
a public hearing was held by the City Council concerning the
request; and
WHEREAS, the provisions of Virginia Code Section 30-19.04 B.
have been examined and considered by the City Council; and
WHEREAS, the City Council supports the request of CCHRC for
the exemption from real property taxation and the City Council
recommends to the General Assembly that CCHRC be classified as a
public park or playground within the context of Article X, Section
6(a) (6) of the Constitution of Virginia.
NOW, THEREFORE, BE IT RESOLVED that, having examined and
considered the provisions of Virginia Code Section 30-19.04, and
after notice and a public hearing, the City Council of the City of
Fairfax, Virginia hereby supports the request of the Country Club
Hills Recreation Corporation to the General Assembly of Virginia to
exempt from local taxation of real property the properties located
at 3622 and 3624 Old Post Road, within the City of Fairfax, which
is owned and used by the Country Club Hills Recreation Corporation
for public park and playground purposes; and
BE IT FURTHER RESOLVED that CCHRC shall promptly pay to the
City the cost of the publication of the notice for the public
hearing related to the consideration of this Resolution.
