A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FAIRFAX,
VIRGINIA, IN SUPPORT OF THE REQUEST OF FAIRFAX SWIMMING
POOL, INC. FOR EXEMPTION BY DESIGNATION FROM REAL
PROPERTY TAXATION PURSUANT TO ARTICLE X, SECTION 6(a)(6)
OF THE CONSTITUTION OF VIRGINIA, AND VIRGINIA CODE
SECTION 30-19.04.
WHEREAS, Fairfax Swimming Pool, Inc. (FSP), a non-profit
corporation organized under the laws of the Commonwealth of
Virginia and exempt from federal taxation under Section 501(c) of
the Internal Revenue Code of 1954, requested that the City Council
of the City of Fairfax, Virginia (the "Council") adopt a resolution
supporting a request to the General Assembly of Virginia to
designate the real property owned by FSP in the City of Fairfax,
Virginia (the "City") to be exempt from local taxation pursuant to
Article X, Section 6(a) (6) of the Constitution of Virginia, and
Virginia Code Section 30-19.04; and
WHEREAS, FSP presently owns two parcels of real estate located
in the City with a total assessed value of $416,600. The annual
amount of real property taxes regarding such property is $4,124.34,
which represents .00022637% of the City's current annual property
tax revenue; and
WHEREAS, pursuant to Virginia Code Section 30-19.04, notice
has been given concerning such request and, on December 10, 1996,
a public hearing was held by the City Council concerning the
request; and
WHEREAS, the provisions of Virginia Code Section 30-19.04 B.
have been examined and considered by the City Council; and
WHEREAS, the City Council supports the request of FSP for the
exemption from real property taxation and the City Council
recommends to the General Assembly that FSP be classified as a
benevolent organization within the context of Article X, Section
6(a) (6) of the Constitution of Virginia.
NOW, THEREFORE, BE IT RESOLVED that, having examined and
· considered the provisions of Virginia Code Section 30-19.04, and
after notice and a public hearing, the City Council of the City of
Fairfax, Virginia hereby supports the request of Fairfax Swimming
Pool, Inc. to the General Assembly of Virginia to exempt from local
taxation of real property the properties located at 4200 Roberts
Road and 10201 Forest Avenue, within the City of Fairfax, which are
owned and used by Fairfax Swimming Pool, Inc. strictly for
benevolent purposes; and
BE IT FURTHER RESOLVED that FSP shall promptly pay to the City
the cost of the publication of the notice for the public hearing
related to the consideration of this Resolution.
