RESOLUTION TO APPROVE THE REQUEST OF DONG A. ASIAN MARKET BY
CHARLES CHOE, AGENT/ARCHITECT, FOR A SPECIAL EXCEPTION TO
CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS DONG A.
ASIAN MARKET, 9590 LEE HIGHWAY, AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 48-3-((9))-1D.
WHEREAS, Dong-A Asian Market, by Charles Choe, Agent, has submitted Application
No. SE-152-94-1 requesting Special Exceptions to the City Code listed below:
Sections 26-39. l(h) and 26-173(c)(1) To allow a building addition that is greater than
30% of the existing gross floor area without all of the required improvements to th~
existing nonconforming parking lot and to allow structural encroachment into the require~
25-foot front yard setback.
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code
Sections 26-39.7, 26-103(c) and 26-173(0 for the following reasons:
Will not result in increased traffic congestion or otherwise negatively impact
existing traffic flow or pedestrian and vehicular safety;
Will not be contrary to the objectives specified in the Comprehensive Plan;
Is necessary to permit the reasonable use of the subject property; and
Will not adversely impact adjacent property or surrounding area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on
this 28th day of February, 1995, that Application No. SE-152-94-1 be and hereby is
APPROVED with the following conditions:
Development of the site in accordance with the approved site plan dated
November 23, 1994, and revised February 15, 1995;
2. Removal of the existing non-conforming pylon sign; and
Repair and maintenance of the existing drainage ditch surrounding the property
boundary.
