19950425 r-95-10RESOLUTION NO. R-95- 10 RESOLUTION TO APPROVE THE REQUEST OF WESTMORE SHOPPING CENTER ASSOCIATES BY N. JOE SIZDAKANI, GENERAL PARTNER, AGENT, FOR SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN AS 10927 MAIN STREET, AND MORE PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-1-((2))-47A. WHEREAS, Westmore Shopping Center Associates, by N. Joe Sizdakani, General Partner, has submitted Application No. SE-156-95-1 requesting Special Exceptions to the City Codes listed below: Sections 26-39.2(e) and 26-173(c)(1) to allow a front landscaped strip 7.1 feet wide where 25 feet is required; and Sections 26-39.2(e) and 26-173(c)(2) to permit a side yard of three feet at the narrowest point where zero feet or 10 feet minimum is required. WHEREAS, City Council has determined that the proposed Special Exceptions are appropriate because the proposal meets the requisites established by City of Fairfax Code Section 26-103(c) for the following reasons: It will not result in a development which is disproportionate to surrounding land uses in size, bulk or scale; It will not adversely affect any nearby residential arms; It will not overburden the community facilities existing or available or result in the obstruction of light and air, danger and congestion in transportation, or increased danger from fire, flood, or other hazards; and It will not be contrary to the objectives specified in the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on this 25th day of April, 1995, that Application No. SE-156-95-1 be and hereby is APPROVED with the condition that the applicant develop the site in accordance with the site plan dated April 17, 1995.
