RESOLUTION TO APPROVE THE REQUEST OF COMMONWEALTH ANIMAL
HOSPITAL BY JOHN M. AND PATRICIA D. HERRMANN, OWNERS, FOR
SPECIAL EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE
PREMISES KNOWN AS 10860 MAIN STREET, AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 57-1-((15))-C-004 AND 005.
WHEREAS, Commonwealth Animal Hospital, by John M. and Patricia D. Herrmann,
owners, has submitted Application No. SE-161-95-1 requesting Special Exceptions to the City
Codes listed below:
Section 26-39.2(c) to allow a zero-foot separation between the proposed addition and the
existing parking lot aisle where a four-foot separation is required;
Section 26-39.4(a)(5) to allow an 18-foot parking lot aisle width where a 23-foot aisle
width is required; and
Section 26-69(a)(1) to allow a minimum eight-foot landscaped strip adjacent to a public
fight-of-way where a 25-foot landscaped strip is required in the C-2 (Retail Commercial)
District.
WHEREAS, City Council has determined that the proposed Special Exception is
appropriate because the proposal meets the requisites established by City of Fairfax Code Section
26-103 and 26-71.2 for the following reasons:
There are extraordinary circumstances which justify the reductions of separation
between the parking aisle and the proposed addition.
The proposed reduction of the width of the parking lot aisle will not create any
hazards for vehicular or pedestrian traffic circulation on or off-site.
The planting of street trees is consistent with the recommendations of the
Comprehensive Plan and the Community Appearance Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on
this 25th day of July, 1995, that Application No. SE-161-95-1 be and hereby is APPROVED,
with the following conditions:

The applicant shall consolidate lots 4 and 5 prior to final site plan approval.
The applicant shall provide street trees along Main Street to satisfy the requisites
of Section 26-69(a)(1) of the Zoning Ordinance and the recommendations of the
Comprehensive Plan and the Community Appearance Plan.
The required street trees shall be planted outside of the sight distance triangle at
the intersection of the driveway with Main Street.
