RESOLUTION OF ENDORSEMENT OF PROPOSED LEGISLATION TO
BE SUBMITTED TO THE VIRGINIA SENATE TO ALLOW INCLUSION OF
CERTAIN FLAMMABLE LIQUID AND GAS STORAGE FACILITIES AS
SECTION 302 FACILITIES UNDER TITLE III OF THE SUPERFUND
AMENDMENTS AND REAUTHORIZATION ACT (SARA) OF 1986
WHEREAS, the City of Fairfax is a member of the Fairfax Joint
Local Emergency Planning Committee (FJLEPC), an organization
established in accordance with the Emergency Planning and Community
Right-to-Know Act of 1986 (SuperfundAmendments and Reauthorization
Act, Title III) for the purpose of preparing an emergency plan to
minimize the impact upon the community of possible release of
hazardous substances; and
WHEREAS, the FJLEPC has adopted a hazardous material emergency
response plan; and
WHEREAS, the FJLEPC has requested authorization from the
Virginia Senate for authority to adopt new criterion for critical
hazard facilities; and
WHEREAS, the FJLEPC, at a meeting adopted the following
language:
"A facility shall be considered to be a critical hazard
facility, and subject to all requirements of Section 302 of
Title III of the Superfund Amendments and Reauthorization Act
of 1986, if an incident at such facility has potential for
sudden release of 10,000 pounds or more of flammable liquids
or gases, not otherwise exempted under Section 327."
WHEREAS, the Chairman of the FJLEPC has requested the City
Council of the City of Fairfax to endorse the proposed language.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FAIRFAX,
VIRGINIA, that it hereby endorses the recommended language.
