WHEREAS, the population of the Northern Virginia region is
highly transient and many residents previously have been confused
by the myriad of differing motor vehicle personal property tax and
decal due dates among the jurisdictions in the region which
unnecessarily complicates compliance with personal property tax and
decal requirements throughout the region; and
WHEREAS, the elected treasurers and commissioners of the
revenue and the appointed finance directors in the various
jurisdictions in the region, known as The NOVA Group, have met for
the past two years and continue to regularly meet in an effort to
resolve these and other problems and mutual concerns;
WHEREAS, as a result of the efforts of The NOVA Group, all
jurisdictions in the region have now conformed to the common
personal property tax due date of October 5th and the common decal
display due date of November 15th; and
WHEREAS, The NOVA Group has obtained statutory authority,
pursuant to Code of Virginia Section 46.2-752 K, to enter into a
regional compact whereby the jurisdictions of the region may
mutually enforce compliance with motor vehicle decal requirements
throughout the region upon execution of a compact to do so; and
WHEREAS, a cooperative regional effort to enforce decal laws
will enhance City revenue through the collection of additional
decal fees, ticket fees and personal property tax collections; and
WHEREAS, the failure of a portion of the population to pay
their full share of personal property tax places an unfair
additional tax burden on those who do comply with their duty; and
WHEREAS, the proposed Northern Virginia Compact for Local
Motor Vehicle License Enforcement is an important step toward
further governmental cooperation between the jurisdictions of the
region which will help to reduce confusion and will greatly enhance
compliance with motor vehicle licensing requirements throughout the
region and which, in turn, will enhance greater compliance with
personal property tax payment requirements;
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the
City of Fairfax, Virginia, hereby authorizes John Mason, Mayor of
the City of Fairfax, to enter into the Northern Virginia Compact
for Local Motor Vehicle License Enforcement and to sign all
necessary documents to do so on behalf of the City of Fairfax.
