RESOLUTION TO APPROVE THE REQUEST OF FAIRFAX KINGDOM HALL
OF JEHOVAH'S WITNESSES, BY KEITH BARKER, AGENT, FOR SPECIAL
EXCEPTIONS TO CHAPTER 26 OF THE CITY CODE ON THE PREMISES
KNOWN AS 3701 JERMANTOWN ROAD, AND MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 47-3-((4))-11A AND 12A.
WHEREAS, Fairfax Kingdom Hall of Jehovah's Witnesses, by Keith Barker, Agent,
has submitted application No. SE-127-93-1 requesting Special Exceptions to the City Code
listed below:
Section 26-39. l(h)(3) To allow an increase of building gross floor area which
exceeds 30% of the existing building gross floor area, without the required design
improvements to the parking lot.
Sections 26-69(a)(1)(a) and 26-112(c)(1) To allow less than the required 35-foot
landscaped front yard (approximately 11 fee0.
WHEREAS, City Council has determined that the Special Exceptions are
appropriate because they meet the requisites established by City of Fairfax Code Sections 26-
39.7, 26-71.2, and 26-103(c) for the following reasons:
The Special Exception permits reasonable use of the applicant's property.
The request is consistent with the objectives of the Comprehensive Plan and
the purpose of the Zoning Ordinance.
The proposed development will not result in negative impacts to adjacent
properties, streets or people living and working in the area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax
on this 22nd day of March, 1994, that application No. SE-127-93-1 be and hereby is
APPROVED.
