RESOLUTION APPROVING THE REQUEST OF PULTE HOME
CORPORATION, BY MARTIN D. WALSH, AGENT, FOR A
SPECIAL EXCEPTION TO ALLOW THE EXTERIOR WALLS OF
A STRUCTURE TO EXCEED THE MAXIMUM SPECIFIED
HEIGHT BY NO MORE THAN 5 FEET ON PREMISES KNOWN
AS 10327 THROUGH 10409 (ODD) SAGER AVENUE; 4013 AND
4017 EAST STREET; 10400 THROUGH 10407 HOLBROOK
AVENUE AND 4017 SIDEBURN ROAD.
WHEREAS, PULTE HOME CORPORATION, by Martin D. Walsh, Agent,
has submitted application No. SE- 135-94-1 requesting a Special Exception
to the City Code Section 26-213.2 to allow the exterior walls of a proposed
development to exceed the maximum height of 43 feet by no more than five
feet; and
WHEREAS, City Council has determined that the requested Special
Exception is appropriate because the request meets the requisites
established by City of Fairfax Code for the following reasons:
1. The affected buildings are located internal to the development and are not
adjacent to existing residences.
The affected buildings are located at a lower topographic elevation than
originally proposed (and are proposed at that location as a result of the
request of the staff).

The proposed building height is consistent with the function that the
proposed development will serve as a transition between commercial
development to the north and west, and the existing residential
development to the south and east.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fairfax on this 28th day of June, 1994, that application No. SE- 135-94-1 for a
Special Exception to Section 26-213.2 of the City Code is hereby approved.
