RESOLUTION TO APPROVE THE REQUEST OF INOVA HEALTH SYSTEM
SERVICES, BY DAVID HUGHES, AGENT, FOR SPECIAL EXCEPTIONS T(
CHAPTER 26 OF THE CITY CODE ON THE PREMISES KNOWN A:
COMMONWEALTH CARE CENTER, 4315 CHAIN BRIDGE ROAD, AND MORE
PARTICULARLY DESCRIBED AS TAX MAP PARCEL 57-4-((02))-013C.
WHEREAS, Inova Health System Services, by David Hughes, Agent, has submitted
Application No. SE-140-94-2 requesting Special Exceptions to the City Code listed below:
City Code Section 26-69(a)(1)a To allow a landscaped front yard adjacent to a parking
area to be less than the required 25 feet; and
City Code Section 26-39. l(h)(2) and (3) To allow a building expansion which increasesi
the amount of gross floor area by more than 30% without all of the requiredi
improvements to the existing parking lot.
WHEREAS, City Council has determined that the proposed Special Exceptions are
appropriate because the proposal, as modified by the following conditions, meets the requisites
established by City of Fairfax Code Sections 26-39.7, 26-71.2, and 26-103(c) for the following
reasons:
1. The request is consistent with the Comprehensive Plan.
2. No adverse impacts are anticipated as a result of granting the request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fairfax on
this 22nd day of November, 1994, that application No. SE-140-94-2 be and hereby is
APPROVED with the following conditions:
The development be in substantial accord with the plan submitted with the
application dated June 1, 1994 (revised August 22, 1994 and October 28, 1994)
and as modified below:

The northern landscape maintenance easement and the other landscape
areas adjacent to the applicant's northern property lines be planted with
evergreen trees in order to provide a screen between the proposed facility
and the adjacent townhouse development.
The western property lines shared with Mt. Calvary Baptist Church be
landscaped with small trees or shrubs in cooperation with the church.
The existing split-rail fence on the western property lines be repaired or
removed.

Within the existing parking lot, wheel stops be provided for all parking
spaces perpendicular to landscaped areas and curbing (or a similar barrier)
be provided around the proposed landscaped islands.
Evergreen shrubs or trees be planted between the new parking lot and
School Street after the driveway is closed.
The narrow portions of the University Drive front yard be landscaped
with plantings designed to screen the parking lot from the right-of-way.
Deliveries be restricted to 7:00 a.m. to 9:00 p.m., with the exception of
bread trucks at 6:30 a.m.

The applicant and/or property owner dedicate to the City for use as a public street
the strip of land shown on the plan as "proposed right-of-way dedication".
Dedication shall be subject to an automatic reversion of title to the land to the
applicant and/or property owner if a public street is not constructed within the
fight-of-way within five years from the time of dedication or if any portion of the
strip of land is not needed for public use.
