A RESOLUTION TO REFER TO THE PLANNING COMMISSION FOR REVIEW,
PUBLIC HEARING AND RECOMMENDATION AN AMENDMENT TO
CHAPTER 26 OF THE CODE OF THE CITY OF FAIRFAX TO CREATE
A SPECIAL EXCEPTION PROCESS FOR RESIDENTIAL USES, TO
REVIEW RESIDENTIAL SETBACK REGULATIONS, AND TO REVISE
ARTICLE 14, ACCESSORY STRUCTURES, TO PROVIDE FLEXIBILITY
FOR UPGRADING AND IMPROVING RESIDENTIAL PROPERTIES.
WHEREAS, the City Council of the City of Fairfax wishes to
facilitate the creation of a convenient, attractive and
harmonious community and to protect against overcrowding of land
and obstruction of light and air; and
WHEREAS, the City Council discussed at a work session on
October 6, 1992, strategies for upgrading residential properties
and reached consensus on pursuing appropriate regulatory
reforms; and
WHEREAS, there exists a need for a more flexible mechanism
to allow special consideration for improvements to residential
properties constructed prior to existing zoning regulations; and
WHEREAS, existing regulations concerning residential
accessory structures may be unduly restrictive in some cases;
and
WHEREAS, it is in the best interest of the City and its
residents to promote the improvement of homes throughout the
City;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Fairfax, Virginia, refe~to the Planning Commission for
review and public hearing amendments to Chapter 26 of the Code
of the City of Fairfax to create a special exception process for
residential uses, to review residential setback regulations, and
to revise Article 14, Accessory Structures, to provide flexibi-
lity for upgrading and improving residential properties.
