A RESOLUTION TO DENY THE REQUEST OF UNIVERSAL RUG AND
CARPET, INC., FOR A SPECIAL EXCEPTION TO CITY CODE
SECTION 26-47(e)(1) TO ALLOW THE ENLARGEMENT OF A
NONCONFORMING SIGN ON THE PREMISES KNOWN AS PIER ONE
IMPORTS CENTER, 11123-49 LEE HIGHWAY, AND MORE PAR-
TICULARLY DESCRIBED AS TAX MAP PARCEL 57-1-((02))-140.
WHEREAS, Universal Rug and Carpet, Inc., by Fred Nikzad,
President, has submitted application No. SE-107-92-1 requesting a
special exception to City Code Section 26-47(e)(1) to allow
enlargement of a nonconforming free-standing sign; and
WHEREAS, City Council has carefully considered the applica-
tion, the recommendation of the staff and testimony received at the
public hearing; and
WHEREAS, City Council has determined that the proposed special
exception is not appropriate because the proposal does not meet the
requisites established by City of Fairfax Code Section 26-47(b) for
the following reasons:
The applicant has not clearly demonstrated that the Sign
Ordinance presents a unique burden; and
Granting the requested special exception is inconsistent with
the Comprehensive Plan and the intent of the Sign Ordinance
to provide for adequate, but not excessive, signage that
enhances the image, appearance, and economic vitality of the
City; and
Granting such a request would result in a flood of requests
along Lee Highway and Main Street.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairfax on this 9th day of February, 1993, that application No.
SE-107-92-1 be and hereby is DENIED.
