A RESOLUTION TO APPROVE THE REQUEST OF SCREEN PRINTING
ASSOCIATION INTERNATIONAL (SPAI) FOR A SPECIAL EXCEPTION
TO CITY CODE SECTION 26-39.4 TO ALLOW A BUILDING ADDITION
WITH A TOTAL OF 91 ON-SITE PARKING SPACES WHERE 94
ARE REQUIRED AT 10015 MAIN STREET, AND.MORE PARTICULARLY
DESCRIBED AS TAX MAP PARCEL 57-4-((2))-15 AND A PORTION
OF EACH OF TAX MAP PARCELS 57-4-((2))-150 AND 152.
WHEREAS, Screen Printing Association International, has
submitted application No. SE-105-92-2 requesting a special
exception to City Code Section 26-39.4 to permit a building
addition with a total of 91 on-site parking spaces where 94
spaces are required, as well as an opportunity to phase the
construction of spaces, at the SPAI site at 10015 Main Street
and a portion of each of 4111 Orchard Drive and 9999 Main
Street; and
WHEREAS, City Council has determined that the proposed
special exception, as modified by conditions 1-6, is appropriate
and meets the requisites established by City of Fairfax Code
Sections 26-39.7 and 26-103(c), for the following reasons:
1. Since the proposal will generate no additional vehicles,
granting the special exception will not increase traffic
congestion or negatively impact existing traffic flow or
pedestrian and vehicular safety.
The proposal continues the property's existing trade
association use and is consistent with the goals of the
Comprehensive Plan.
Approval of the requested special exception will permit the
reasonable use of the subject property.
Since the proposal does not represent a proportionate
increase in employees and site design meets buffer and
landscaping Code requirements, approval of the requested
special exception will not adversely affect adjacent
property or the surrounding area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Fairfax on this 23rd day of February, 1993, that
application No. SE-105-92-2 be and hereby is approved with the
following conditions:
The special exception is granted solely to Screen Printing
Association International for the use which is now proposed
and is not transferable.
Parking shall be provided substantially in accord with the
General Development Plan approved by the City Council. The
construction of the new parking spaces shall be phased as
shown on the Plan. The Phase I parking spaces shall be
provided at the time the proposed building addition is
constructed. The Phase 2 parking space area shall remain
as additional open space until such time that the City
Zoning Administrator requests construction of Phase 2.
Within 120 days after written notice of such determination,
the applicant shall submit a site plan to the City for the
construction of the Phase 2 parking spaces.
The association shall limit instructional activities to a
maximum of nine students at any one time.
This special exception may be reviewed and amended or
revoked by City Council if it deems that the conditions of
the special exception have been violated.

Should this special exception lapse either through
revocation by the City Council or by termination of the use
proposed by the applicant, the applicant shall, within 90
days of said lapse, take steps to bring the parking up to
requirement of the Code, excepting that should the building
be sold to a purchaser who can, in the opinion of the
Zoning Administrator, meet the same conditions imposed upon
the applicant, this requirement shall be waived.
These conditions shall supersede the development conditions
approved in SE-i-85-1 (City Council Resolution No. R-85-23)
and such former conditions shall hereafter be null and
void.
