RESOLUTION AUTHORIZING THE CITY OF FAIRFAX TO FILE JOINTLY WITH
FAIRFAX COUNTY, THE CITY OF FALLS CHURCH AND THE TOWNS OF
CLIFTON, HERNDON AND VIENNA FOR FEDERAL COMMUNICATIONS COMMISSION
CERTIFICATION TO REGULATE BASIC SERVICE TIER CABLE TELEVISION
RATES AND ASSOCIATED EQUIPMENT CHARGES.
WHEREAS, the Cable Television Consumer Protection and
Competition Act of 1992 (the "Act") requires that a local cable
television franchising authority receive certification from the
Federal Communications Commission (the "FCC") in order to be
legally authorized to regulate basic service tier cable television
rates and associated equipment charges; and
WHEREAS, the City of Fairfax is the local franchising
authority for the City; and
WHEREAS, the Act permits local franchising authorities to file
joint certifications and to exercise joint regulatory jurisdiction
over such cable television franchises; and
WHEREAS, the City of Fairfax and Fairfax County are served
with cable television services by Media General Cable; and
WHEREAS, it would be in the best interest of the City of
Fairfax to obtain joint certification from the FCC and exercise
joint regulatory jurisdiction with Fairfax County and other local
governments served by Media General.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Fairfax, Virginia, that the County of Fairfax, Virginia (the
"County") is authorized to file, with the Federal Communications
Commission, a joint certification, which includes the City of
Fairfax (the "City"), for the regulation of basic service tier
cable television rates and associated equipment charges by the
County, the city, the City of Falls Church and the Towns of
Clifton, Herndon and Vienna. The City's share of the costs for
certification and rate regulation will be billed by the County to
the City based on the ratio of Media General's City cable
television subscribers to the total subscriber base of the Northern
Virginia Media General cable television system. This annual cost
for certification and rate regulation is estimated to be 2.5
percent of the total system cost and shall not exceed $2,500.00
without further authorization from the City Council.
BE IT FURTHER RESOLVED that the City Manager of the City of
Fairfax is authorized to execute all documents on behalf of the
City necessary for the County and the City to file for such joint
certification and to exercise joint cable television regulatory
jurisdiction.
